1. Products:
a. Made-to-Order Clothing: Our made-to-order clothing items are made when you purchase the clothing to prevent waste or customized according to your preferences.
b. Paintings: Our paintings are original artworks and are available for purchase and available for commission/made to order
c. Readily Made Products: We also offer a selection of pre-made clothing available for immediate purchase and shipment.
2. Ordering Process:
When placing an order for made-to-order products, you will be required to provide accurate and complete information, including your measurements and design preferences. For readily paintings and readily made products, you can directly purchase the items from our website. We reserve the right to cancel any order if we suspect fraudulent activity or if the product is out of stock.
3. Payment:
Payment for your products is required in full at the time of placing the order. We accept payment through Paypal and creditcard. Prices are listed in Euro's. Please note customers are responsible for any additional customs and import taxes.
4. Shipping and Delivery:
Shipping costs and estimated delivery times vary based on the destination and the type of product purchased. We are not responsible for delays in production, shipping, or delivery caused by circumstances beyond our control, such as customs delays or natural disasters.
5. Returns and Refunds:
a. Made-to-Order Products: Due to the customized nature of our made-to-order products, all sales are final. Please review your order carefully before confirming your purchase.
b. Readily made Paintings and Readily Made Products: If you are not satisfied with your purchase, you may return the item within 14 days of receiving it for a refund or exchange. The item must be in its original condition, unused, and with all original tags and packaging intact. You are responsible for the return shipping costs.
6. Intellectual Property:
All content, designs, logos, and images on this website are the intellectual property of Midheavens. You are not permitted to use, reproduce, or distribute any of our intellectual property without our express consent.
7. Limitation of Liability:
In no event shall Midheavens be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use our products or website.
8. Governing Law:
These Terms and Conditions are governed by and construed in accordance with the laws of The Netherlands, and you agree to submit to the exclusive jurisdiction of the courts located in Bergen op Zoom for the resolution of any disputes.
